It was revealed earlier this year that the telephone numbers which cold callers use to habitually pester Consumers originate in part from loan companies.

In a recent article published in the Daily Mail Deborah Winch reported that she was “continuously pestered by spam texts after a loan was declined”. Since receiving those texts, she was scammed out of over £350 by cold callers who consistently promised a dream which in reality never materialises.

This is not a rare incident as over 3,000.00 complaints have been received.

In respect to timeshare, where do the cold callers get the telephone numbers and information from?

There are many purported legal companies employing many cold calling operators so as to speak to unwitting Consumers. Those conversations then lead to selling Consumers a legal dream which in many cases, never materialises.

Cold calling is in some cases, is illegal and immoral and ought to be viewed as a trigger for suspicion.

Promoting litigation is reckless behavior at best. Companies, who do so, ought to be jailed.

Many, many times salesmen arrive and take thousands of pounds off Consumers promising lavish days ahead when the case is won. However, what they do not tell you is the full forward costs of litigations as well as the possibility of adverse cost orders which could come back to bite.

Once substantial amounts of money are taken from many Consumers, one scamming company spoke to the Consumer in the words of “catch me if you can”.

In 2005 there have been many bankruptcies of many timeshare resorts and many others are under serve financial pressure due to a flow of judgments which will ultimately leave timeshare operators impecunious.

promoting legal actions is wrong because even if a Consumer does have a just and rightful claim, they could protract the litigation for many years, win their case and ultimately find out that the Defendant is insolvent and unable to pay his debts.

If Consumers are cold called we repeat, the best advice we can give is that they put the phone down immediately and do not engage with them.

Christopher Woolard of the FCA said;

               “This exploitation of Consumers (many of whom are venerable) is unacceptable. Knowingly passing on data without consent is wrong”.

A Government advisor and pension expert Dr Altmann said;

               “Prison sentences and significant fines should be imposed on those who recklessly profit from such data”.

The Government is now acting and investigations into cold calling companies, their employees, Servants and agents are underway and they expect many prosecutions during this and next year.

Media Blanket Ltd who owns “Super Loans” and various other internet websites admitted that it had passed on data.

There appears no excuse available to company Directors as they are responsible for their actions and on occasion, the responsibility will pass to the employees if they know or ought to have known that the activities of the company, breached regulations.
