A class motion lawsuit filed against Marriott Trip Membership and First American Title detailing claims of misrepresentation and racketeering has been uncovered recently. With Marriott’s attorney now refuting the claims as without benefit and their attorneys Green Traurig, of Orlando have submitting a writ to the county court to disprove the allegations made by current members.

These members claim that Marriotts have misinterpreted the product they actually purchased, by demanding these clients pay the extortionist closing fees, recording charges and title coverage for owning a property that they will never ACTUALLY own.

Marriott´s have disputed the allegations as false and are willing to defend themselves in court by submitting their 50-page application to dismiss the discrimination lawsuit.

With Marriotts suggesting:

“ It is evident from these allegations that the plaintiffs have misinterpreted the statutes that they assert have been violated, the allegations are without benefit and the MVC Plan absolutely complies with relevant regulation.”

This inconsistency was shown with multiple consumers purchasing their ownership in one county while having the legal documentation registered and approved in neighboring county´s. Firstly Anthony and Beth Lennen who purchased a unit at Crystal Shores on Marco Island although the actual deeds of ownership were registered in Orange County.

As the owners have deeds recorded with totally meaningless codes that are conflicted by different county´s, this is precisely what makes the contracts unlawful and why they are pushing to be overturned and declared null and void.

First American Title – the trustee for Marriott’s land belief are happy to include themselves in the fight and have supported Marriott’s by submitting their own 27-page movement to dismiss also stating:

“ The Lennens made an option to buy the title insurance coverage, and they signed agreements that state they couldn’t sue over the timeshare program itself.”

With this information at hand it is no surprise that the president of the Nationwide Timeshare Affiliation, Greg Crist has admitted he would happily welcome an evaluation of all allegations by a state regulator.
