To add to the many recent reports on Anfi, we here at TCA are delighted to confirm yet another Anfi owner has recently triumphed against the timeshare company at the Spanish Supreme Court. As reported just last week the courts have sided with the owner’s yet again, confirming the court’s stance on the illegal actions it has proved Anfi used against its members.

The basis of the case has been to review the conditions of the existing contract to assess if they have been mis-sold their ownership by Anfi.  Many of the fraudulent contracts in the firing line include the floating week option along with the dreaded perpetuity clause.

The victorious owner in question has had their contract with Anfi declared null and void by the Supreme Court in Madrid.  They too held a floating contract which detailed perpetuity.  This move has been applauded by other Anfi owners who have also been fighting their own lengthy battles concerning the illegal contract the timeshare company have been supplying to their unwitting owners.

This jubilant owner is in line to receive a whopping 45,825.77€ along with the possibility of additional funds to cover interest on payments made and also the possibility of regaining lost legal fees.

The Courts have now severely reprimanded Anfi for its practices against its owners regarding the clauses masked within their contracts. Along with this ruling the courts have strongly reiterated its position on the illegal deposits being taken and have now ordered the timeshare company to refund double the monies deducted for the deposits to its rightful owner, as legally any deposit payment Anfi took is illegal.

We at TCA are positive this is just the beginning of what is proving to be a very costly year for the Anfi Group. One hopes the existing owners are not going to pay the price for Anfi’s misgivings.
