I resign my membership in the club forthwith.
In doing so, I reserve at all material times my right to action a claim for damages and/or compensation – by way of any forum I deem appropriate and/or against you, the seller, or any other person named or unidentified at present.
Further I reserve my right the seek damages as a result of any misrepresentations, breaches of contract, tortuous interferences and/or frustration. To avoid any doubt-this resignation does not intend to negate or affect any rights I currently enjoy.
My resignation is as a result of the following, is irrevocable and final.
I reserve at all material times the right to show this termination notice to a court if and when appropriate to do so.
Issues
I suffer from a long term illness which prevents me for exploiting the rights I have acquired. That illness and inability to travel is confirmed by my doctor and is enclosed at appendix.1
It was a representation that I would be able to use my timeshare holiday for the rest of my natural life and I fully intended to do just so. The illness has frustrated that right as I unable to use/exploit the rights afforded. This event was not envisaged and it would inappropriate to force to me to comply with the contract terms and conditions. Equally it is unreasonable to expect me to pay ongoing fees due under the constitution as I would not receive any corresponding benefit.
The equitable thing to do would be for you to take the ownership of the timeshare from me and dispose of it to another who could receive benefit. You are required to act reasonable and proportionately in such circumstances.
Alternatively it has been determined by the RDO that people is such circumstance shall be released. To avoid doubt, it is irrelevant whether the resort is a member of the RDO or not. As the RDO is only organisation who represents the resorts and believes such action to be just and reasonable I am entitled to be guided by the industry experts.
That being the case, I hereby relinquish my membership forthwith.
Note:-
In the event you challenge this notice you are required to fully particularise your issues and apply them against the “unfair terms legislation and “The Timeshare, Holiday Products, Resale and Exchange Contracts Regulations 2010”. To avoid doubt I reserve at all times other issues, I have with regards my ownership of the timeshare as this time I believe it is presently reasonable to do so.
I reserve at all material times the right to show this to a court if and when the issue of costs and pre action disclosure is discussed.
