This statement, I find repulsive as it tends to reflex a goodness which is not there. Why?

Because you are entitled to the exit in any event.

What everyone must find strange is that when a resort offers you this so called free exit it does not come without a “consideration”.

That consideration is that the resort insists you (the consumer) cannot issue Proceeding against the seller of your timeshare for breach of contract, mis-selling etc. They also insist you still have to pay you finance or that you cannot bring a section 75 claim against the seller.

The obvious question is why is the club (which you are a member of) insisting that the selling company is not sued, is protected is absolved of any sin.

The selling company is a different company not entitled to a voice in the club you are a member of.

The management company is, again, not the seller and is supposed to be employed to protect your rights in the club. As that management company is you servant and agent, why are they medalling in the sales contract? What benefit passes to them for the obvious protect they give to the seller?

Who controls the club? Why is the club holding you the consumer to ransom for the benefit of another?

When you trade in your car- does the buying garage only agree to take the car off you-if, and only if, you agree not to action a claim against the garage that sold it to you? Who’s pulling whose strings?

A racket is a service that is fraudulently offered to solve a problem. I.e. for a problem that does not actually exist, that will not be put into effect, or that would not otherwise exist if the racket did not exist.

Conducting a racket is racketeering. Particularly, the potential problem may be caused by the same party that offers to solve it, although that fact may be concealed, with the specific intent to engender continual patronage for this party.

To avoid doubt, we are not claiming that this is a Racket. However, with regards to the timeshare industries reputation, transparency and claimed efforts to prove the timeshare experience is this the way to go about it? Is this the claimed “time for change” programme? Is this the new day proclaimed or is it an unintended Racket?
