Some resorts are no strangers to contentious situations and often land themselves foul of the courts on many occasions. Silverpoint/Resorts Solutions are one of those organisations. They have in the past been investigated by a variety of bodies and as to their selling activities. In recent times one of their leading principles was arrested and convicted for crimes perpetrated against consumers.

Upon reflection selling a product is just one disciple that is incorporated in a trading entity. Company activities include accounts costing, employment, pursuing of services, maintenance of asset schedules, as well as many other activities which are done to make a company successful.

I could go on forever, however the prickerly problem with the trading activities in the Silverpoint/Resort properties organisation is selling. If therefore there is a fundamental problem with a discipline you would expect that any businessman in charge of an enterprise would seek to correct it’s faults, so that the product which the company sells or services is good and reasonable. If that were addressed then the income streams in the future would be safeguarded and the longevity of profit streams would continue. That in short is the job of the Managing Director i.e. “to manage the business”.

Not to consider any action your enterprise would flounder. If you are a reasoned businessman then you would be in breach of your duty to the very organisation you purported to guide manage or represent.

The present incumbent of the Silverpont/Resort Properties enterprises is Mr Mark Cushway who is a salesman (in his own right) and also the subject of a criminal indictment (he was recently summons to the criminal court to face allegations of a criminal nature). Equally so were many of his employees / representatives / agents or servants.

That criminal case is yet to be determined, however as the enterprises are constantly in the limelight for reason which are of a serious nature and which could affect the image of timeshare. This be the case you would have to believe that the RDO and TATOC would suspend him and his enterprises until such time as they were cleared of the allegations.

The RDO and TATOC claim to be the legitimate authorities whereby consumers could be confident that those institutions would act in the best interest of the timeshare industry and the corresponding consumers. One might believe that they would take action to preserve and protect timeshare yet they don’t. They don’t act in protection, in support of the reputational management of the industry or the consumers which are affected by the alleged antics of some; they don’t suspend members like Silverpoint/ Resort Properties. Alas they don’t do anything other than defend them, there companies and they affiliates.

Equally Mark Cushway is a Director of the RDO and you might believe that if such allegations are raised against a director of an organisation which has ethical standards then they would depose that director until there has been a cessation of the claims made. Again the RDO have not suspended Mark Cushway.

In stark contrast the incumbent Silverpoint Director is exonerated. Mark Cushway is still a Major Director of the RDO and a prolific supporter of TATOC. TATOC (in support of this man) has placed on its website a statement from Mr. Cushway which refutes the allegations made by consumers yet TATOC do not establish what allegation were, and made by the very consumers they purport to represent.

It will also not come as a shock to believe that Mr. Cushways enterprises also financially support other self serving enterprises like mindtimeshare and kwik-Chex. Mr. Cushway appears to have a determination to employ institutions for a purpose and that purpose is not to assist consumers to leave the grips of his timeshare resorts. In truth if consumers were to leave then of course he and his enterprise would be financially strapped and he would lose the ability to fund the very lifestyle he has become accustom to.

Without doubt Silverpoint and Resort Solutions sell timeshare to consumers for values which far exceed what those very timeshares are sold on the resale market. This begs the question how do they do it? What must be said in those very long presentations, so as to persuade a consumer into believing that what is being sold has a value and an enrichment which other re seller cannot provide?

In reality the products are the same and it’s just the presentations which vary.

Is this the reason why Mr. Cushway and his enterprises are no strangers to the Spanish, English and other European courts birth civil and criminal?

If the RDO and TATOC were to take stock of the activities of this resort and honestly reflect on the continuous complains, allegation alleged offences and past judgments, you would think that action of some sorts would have occurred. In reality all we see on TATOC website is a statement from Mr. Cushway denying everything and being presented as the good guy. The act of permitting this statement on the TATOC website is wrong, inflaming and take away any credibility it claims to have.

To be included on a purported (and industry claimed) consumer website, is a further indictment of the position TATOC takes. There are no corresponding allegations to the statements given by Mr. Cushway by consumers (who allege the wrongdoing). Moreover nowhere on the website is there any information given to consumers as to how they can action a claim against Mr. Cushway Companies in support of the very 350,000 consumers they say they exist to serve.

I say this as if consumers are making claims and seeking damages and those claims are as a result of misrepresentation made at the resorts and by Mr. Cushway or his apostles, then would it not be right and just to have all the worms coming out, so as to clean up the industry. That is (after all) the Claim of TATOC and the RDO. This is why we believe the claims are merely hot air, idle and ridicules at best, as in reality these website serve a purpose and that purpose is to protect the very resorts which finance them.
