You the consumers are cordially invited to attend a meeting of the proposed xxxxxxxx Owners Club 2014
That meeting will be held on the xxxxxxx in xxxxxxx (exact location pending)
Any xxxxxxx consumer who owns a timeshare atxxxxxx Resort will be permitted to attend.
Any and all attendees will discharge their own costs in attending and will not seek to recover any of the costs and expenses from the TCA.
(Please note:- this meeting is orchestrated by the TCA and in accordance with it’s duties to all consumers who hold or did hold timeshare at the xxxxxxxxx Club in the resort of xxxxxxxxx.)
In attendance at the meeting, will be three officials of TCA and others.
Any person can have in attendance a legal representative or McKensey friend if the TCA have been informed in advance of their attendance.
Any other person who seeks to assist or canvass a commission to assist will be permitted attendance if the TCA have notice and they have the interest of consumers in mind.
Purpose of the Meeting
To discuss the events of the xxxxxxx AGM and the impact on timeshare contracts.
The options available to all consumers who have timeshare at the resort.
When options have been discussed and agreed each consumer can either elect to leave the meeting or consider joining one of these groups.
(The TCA understands at this stage there are 3 possible groups)
1) The group who wishes to accept the terms of the amended constitution.
2) The group who wishes to sell/exit/transfer their timeshare as a result of the AGM.
3) The group who wishes investigate the possibility running a legal group action against xxxxxxx and the club committee.
Note
This part of the meeting will be under the direct control of the TCA and is meant to inform, assist and test issues.
At no stage in this meeting will any person, representative, firm or company try to induce or mentally manhandle another into a decision to join any group. At any part in the preceding the TCA reserves the right to expel and without notice anyone disrespecting or shouting down another consumer. The TCA will not permit one consumer to cajole another. This, at all times, will be an orderly meeting to discuss options.
When concluded, anyone can choose their own path, perform their own action and in pursuit of their own goals, in their own time.
Any attendee may take notes at the meeting, they can consult any other association, consumer organisation, solicitor etc in pursuit of assisting them and them alone.
The TCA will not charge attendees to come to the event, however they will pass a bucket round in the hope that the attendees contribute to the costs involved in staging the event.
Stage Two
Setting up the committees to assist the consumers
Each consumer will have a right to vote in this election and this vote will be final.
All votes cast will be counted by an “officer of the court” and committees will be formed if required.
At this stage the TCA only attends the meeting at the will of the committee (s)
The committee will discuss matters with the group and they will vote to establish the clubs purpose, its goals, its funding requirements and its objectives.
After the above has been affirmed, the attendees and seconds can elect to join the club.
At no point does a consumer become affiliated, associated, linked or a member of the club. The only time the consumer becomes a member of the club is by their own free will and volition and when they elect to do so.
Please note that this is a consumer on consumer arrangement and your cooling off rights are ineffective in respect to joining a consumer club. In the event that such is not the case, by joining the club you irrevocably wave any and all rights to a cooling off period.
Any present timeshare owners will have the right to stand as a representative of the club committees and the TCA asks that you consider it well and take into consideration the following statement:-
It is not the TCA Club, it is yours, You will run it, manage it and on behalf of the others.
The belief is that your timeshare (which you acquired for your benefit) will be altered by a person or persons not permitted to do so.
Application to be a Committee Member
You should (when considering putting yourself forward) view this as one of the biggest opportunities of your life, as you will be at the heart of what could be the largest litigation in timeshare history.
This will give you either a springboard into business life, a provide a platform for justice or an elevation to do something right.
Why you want the position is between you and your own thoughts. The only reward you will get is living in the contentment that this day you stood up, you made a choice and ran injustice out of a large industry. Further you did it for the benefit of others. If that inspires you then consider this.
This committee wants you, this committee needs you! You might think that you don’t have the brains, the experience, the legal understanding and may fear the opponent. One of the biggest questions you might ask is “I am just me” and “I might be stepped on and brushed aside”. Firstly you are right to think these things, right to question, but this committee does not need brains, does not require a raft of qualifications. This committees needs:
Tenacity, patience, understanding, questioning, savvy people
It needs orators, considerers, helpers and guiders
Fighters, defenders, carers, grit guts and compassion.
These are the qualities you need, and I believe you need to consider. It’s not about regions, honours women or man. It’s about electing “a force to be reckoned with” with people who want to make a difference.
Good committee members are not pushed into it, not cajoled, they put themselves up, put themselves out and stand in front. Are you one of those people?
You may not be elected; you may think that could attract shame, well that’s a fantasy. You have shown you want to make a difference and will be commended, will stand out and shine in the eyes of many. Please consider this matter fully and contemplate the journey you might take!

Note
“you will be required to give a small presentation at the meeting and you will be given every assistance from the TCA before the meeting starts. You will be polished and good believe me”!
This candidacy has to be returned to the office of the TCA by 15th of July 2014 so that the contents can be circulated to attendees of the meeting
