Over the last few months we have received a lot of enquiries in respect to existing proposed and possible group actions.
In respect to existing actions
I believe 3 of those actions are still in progress, some are being settled on terms and those terms are private issues between the parties, which neither the members of the action nor their committees can discuss with us. That said the settlements will be to the advantage of the members
The pre actions investigations group actions
These appear to be doing very well with all varieties of assisted costs advantages in place which has placed substantial stress on the resorts/clubs.
Each firm I have contacted has expressed their cases do have a distinct advantage, as the cases are well funded and well educated members with good member representation.
The advantages they state and at this early stage are that each member of the action is backing up other members who are describing the same set events.
This will assist each and every member as the sub groups issues are substantiated by large amounts of direct testimony which will assist the consumers in passing the balance of probability rules.
Some groups are now actively engaging the resorts with a view of reaching a settlements. At present no group is under stress with differential risk projections.
