An appeal filed recently by a private prosecutor on behalf of a Silverpoint member has been dismissed this week by the Santa Cruz Provincial High Court, Tenerife. The records state that the court agreed that “there were no indications that any criminal offence had actually taken place.”

This ruling comes hot on the heels of yet another case that swung in Silverpoints favour at the Criminal Court of Arona Tenerife, when a similar case was also thrown out as the courts ruled “no dishonesty had taken place” and that it was “difficult to consider that it is a criminal illegality when it is not even considered a civil illegality”.

On review of the reports presented, the courts governed that Silverpoint and the Public Prosecutors Office were accurate with all documents submitted and the dismissal is final and as such have now categorically closed the case.

With Silverpoints COO, Diana Aitchison commenting:

“Once again Silverpoint has been completely cleared of any wrongdoing. We are pleased that this situation has been resolved and that our name has been cleared”

This has came at a time when Silverpoint seems to be winning every single court case taken against them. In the last eight weeks Silverpoint have proved victorious with five straight out wins and 16 further High Court rulings in its favour. These cases have been brought forward by owners who have had enough of trying to reason with Silverpoint to allow them to exit their membership.

So many of these owners have taken advice from companies who offer impartial exit possibilities, with Silverpoint declaring these court cases as a ruse to create a cloud of negativity around Silverpoint and Holiday Ownership products across the board.

Silverpoint have urged their owners who may have any outstanding issue with their holiday ownership to contact them direct with any grievance to allow them to explore possible solutions before commencing any costly legal proceedings.

As Silverpoint are proving to be hard to beat in court, how successful is one likely to be when allowing Silverpoint to rectify a situation which they were reluctant to acknowledge in the first place.
