The Regency Country Club in Chayofa Tenerife, has been hit with a 1.6m Euro fine for breach of its construction licence by operating as a hotel when it should have been solely used as a residential development.

The Regency Country Club in the Chayofa hills, a few minutes outside Los Cristianos and Playa de Las Américas, was hit with a fine of €1.6 million by Arona Council for using its premises as a hotel and the massive sanction has been upheld by the Canarian High Court, which rejected an appeal by the owners against the council’s decision.

The Regency Country Club was built in two stages and was only authorised to be used as a residential property, but it has been found that the owners had invested in a conversion for a use not authorised by the planners.

The club had been sold to timeshare owners as a private members club, with members paying for the exclusive use of the resort. But with dwindling sales of weeks and the need of a cash injection to complete the resort the decision was taken to offer the resort to the general public on a typical rental basis.

The resort was offering accommodation through many web based holiday discount sites.

The country club has a children’s play area, as well as a tennis academy, a sauna and a fitness center, which may be used at an additional cost. A personal trainer can arrange special training programs. Discounts are available for the tennis academy, at one of the restaurants and at Siam Park Water-park.

The apartments, studios and villas at Chayofa Country Club are large and well furnished. All accommodation has satellite TV and a rental safe. The kitchens have a microwave and fridge, and some have dishwashers.

The main bar and restaurant offer live entertainment in the evenings. There is also a second restaurant. Wi-Fi is free in the bar area, and is also available in reception at an extra cost.

So now we wait to see if the local council will ensure the Club is used only for its intended purpose, and whilst this is being typed on the 7th march 2016, we can still book through any of the discounted holiday/accommodation sites. And what could this mean for all the other Timeshare companies who continue to rent unused weeks?
