In any normal claim there is a dispute. That dispute is a result of 2 or more parties having differing opinions which cannot be settled without the decision of a Court.

For example;

You buy a timeshare

The seller of the timeshare miss sold it to you and made miss-representations

You complain to the seller and try to leave but they refuse and dispute your claim

You go to a Solicitor or legal firm in order to exit the timeshare and claim for the wrongdoings against you

Both parties go to Court and the Judge decides on the balance of probability and evidence presented, who the reasonable party is.

Or, a claim is made to the bank under Section 75

And hey presto, the matter is resolved.

Now, let me give you another scenario;

You buy a timeshare

The seller of the timeshare miss sold it to you and made miss-representations.

You complain to the seller and try to leave but they refuse and dispute your claim

You go to a Solicitor or legal firm in order to exit the timeshare and claim for the wrongdoings against you

All seem normal? Yes. Not for long

You then receive a letter from the seller, advising you that instead of pursuing a claim against them for miss-selling/miss-representations THEY WILL ASSIST YOU IN MAKING A CLAIM AGAINST THE SOLICITOR WHO WAS ACTING FOR YOU….

Below is correspondence that is allegedly being sent to all owners at Fairways & Pueblo Evita Clubs. Wait for it… by  Ian Goddard, the Developer for Fairways and Pueblo Evita!!!!!

If this is true, and I truly hope it isn’t, then the the resorts that sold you the contract which you are trying to leave, are shamelessly attempting to get you to pay them more money to target the companies who are helping you to get out of them in the first place.. Am I going mad? Is this a sick joke?

If you purchased floating weeks and/or a contract that was in perpetuity from these resorts or if you feel the timeshare was miss-sold to you then you have every right to make a claim. You have every right to throw them in front of a Judge. You have every right to justice. Equally, If, you have paid a rogue exit firm or seller to get you our of your timeshare and it has not materialised, then yes, you can make a claim. But not through the wolves that are refusing to let you leave your timeshare!

If this correspondence is in fact true, then we would be very, very interested to hear from Mr Goddard. Why are they doing this? The only logical explanation is that this is an attempt to distract the consumers from fighting them by waving a distasteful carrot in their face?.

The fact is that the consumers have been forced into the arms of these sellers/exit firms, because the timeshare wolves have refused to assist them in leaving the contracts. If Pueblo Evita had put the consumers needs first from the beginning then this would never have happened.

They propose to make a Section 75 claim on your behalf and will take a cut if you are successful.. What about the timeshare that you are trying to leave? are they going to add an exit in this deal? I don’t think so.

To make it clear, you are going to let them outsource your claim to an unknown company to make a claim that you can make yourself, FOR FREE, to get money back from the “bad guys” that were helping you get away from the “bad guys”.  As you can probably tell from this article, this has blown the TCA’s mind.

I urge, no I demand that anyone who is actually considering this route, contact the TCA first. We can give you the details on how to get your money back from both of these companies without this farcical offer.

Important information from Fairways & Pueblo Evita Clubs

Dear Member,

Just before Christmas we wrote to you with an option to, potentially, claim money back from companies that have claimed, in the past, to be able to sell or dispose of your timeshare interest with us.

We are only too aware that there are dozens of companies contacting timeshare clients in the UK with different offers and schemes and understandably there was some concern from a great number of members that this too may be one of them even though the mail came from us and is a genuine opportunity.

I know personally of many members that have paid thousands of pounds to third party companies all promising various options to be ‘rid’ of their timeshare interests and almost all have failed to do what was promised.

It was with great interest, therefore, when I was introduced to a company last year that showed me hundreds of cases where they have claimed money back on behalf of clients where the above was the case. In many cases not only getting back the original amount but also damages and interest, often amounting to thousands of pounds returned.

This is achieved by making claims against the banks that provided credit card or other financial services at the time that money was handed over, even if the company in question is no longer trading.

We have extensive research on this company and are assured that the claims are genuine and are happy to report that some of the initial enquiries from our clients are already proceeding.

If, In the last few years, you have spent money with any company that has claimed to sell or dispose of your weeks and not done what was promised and if any part of your transaction was paid on a credit card it is likely that your claim will be successful. And if this is the case you only need to call us and will pass your details to them.
