Not pulling any punches, “misleading is lying” and many lie in the timeshare industry, many mislead, or trick and all for a reason and that reason is to take your money and/or bind you to something you did not want to be locked into.

This lying can be done by people companies, traders, institutions, organisations not for profit enterprises, firms, solicitors charities ect and so on, practically anyone who want to get your money!

Once they have your money and if you demand it back, you’re in for a fight and troubles will follow you at many stations.

So Think!!!!!!!

Example

If a trader claims they are going to cease trading or move premises when he is not. They are lying

If you have been subjected to this, it is again wrong and an immoral practice.

Extend the principle to timeshare.

Some resorts have and are still employing others who are representing to consumers that their resort are closing and it’s in their best interest to move resorts and switch contacts.

They have a great deal for you (They say!). They like YOU and they are helping you, as you are special to them.

They make wild claims as to what you will lose if you don’t heed their advice.

They explain you are locked in, and massive costs are around the corner and if you don’t do what they advise you to do, and then you, your family and the children will cop a bill which will be crippling. Sign now before it’s too late

In stark reality they are lying to you. Go home and give the rant some good thought, sign nothing and seek advice.

It’s misleading wrong and a misrepresentation.

Consumer should at all times listen to the advice they are given and sign nothing on the day.

The first objective any consumer has to consider is “Do you believe in and trust the advisor”(the representor). To come to that realization, you need to think and you can’t do that when you are listening and taking notes at a presentation.

Be fair to yourself and give the appointment- of your advisor- just and meaning full consideration. Go on a forum, speak to others and form a view you are happy with.

Timeshare is amuck with rouges and Harlots as well as traps and snares. If in doubt call your own solicitor and explain matters to him. It might cost you some money,( for that legal advice) but it is independent and well worth it, if it stops you barking up a tree which is about to shower you with scammer dream

Misrepresenting is mentioned and affirmed in The Consumer Protection from Unfair Trading Regulations 2008 (known as the CPRs).

It is therefore unlawful

Enforcers may take civil enforcement action in respect of a breach of the CPRs under Part 8 of the Enterprise Act 2002. This can be done by applying to a court for an enforcement order and a breach of any order could lead to up to two years’ imprisonment and/or an unlimited fine.

The CPRs also contain criminal offences that can be prosecuted by the Competition and Markets Authority, trading standards services, or the Department of Enterprise, Trade & Investment in Northern Ireland (and by the Lord Advocate in Scotland). The penalties are:

  • on summary conviction, a fine not exceeding the statutory maximum (currently £5,000)
  • on conviction on indictment, an unlimited fine and/or imprisonment for up to two years
