I bought a Spanish timeshare contract from another can I claim the compensation as I own beneficial interest?

The simple answer is “yes” you can!

When you bought your timeshare you will have paid a consideration and as such you inherit all the benefits and liabilities (as the say).

Those benefits and liabilities in Spain included such things as the past rights under the transfer. So in short if your predecessor in title had a right to claim the compensation then you step into their shoes and you can claim it as well and as if you were them.

Firstly the question is do you have the transfer documents?

If so do they contain any information as to the amounts they paid and when they paid them? If they do you can claim the entire amount. If they don’t the question has to be, can you get in touch with the seller (say via the broker you bought if from) and obtain the information? If you can you might have cut a deal with them but it has to be worth it in the long run.

If your brokers are obstructive with you and they are members of the RDO or TATOC you may have a claim against them.
