KwikChex Ltd is a company owned and operated by Mr Chris Emmins. This is a company that prides itself on providing accurate information to consumers and businesses, battling on their behalves to maintain high standards in the industry. KwickChex has been approved by the Chartered Trading Standards Institute (CTSI) under their Buy with Confidence Trading Scheme. The Scheme provides consumers with a list of local businesses which have given their commitment to trading fairly. As such, it is assumed that KwikChex have been vetted to the highest standards.

KwikChex is not however independent, as the company describes it’s funding operations as follows; “All assistance to consumers is completely free, with funding being provided by the Resort Development Organisation (RDO), the representative organisation for timeshare developers in Europe.”  This relationship between KwikChex and the RDO does however create a conflict of interest when it comes to providing accurate information to consumers.

The Resort Development Organisation (RDO) are understood to be KwikChek’s largest client. This organisation represents the interest of the timeshare industry in Europe, they fund the Timeshare Task Force which is an initiative also managed by KwikChex. Some of their past and present timeshare resort/group members include Azure Resorts, Club La Costa Resorts (CLC), Diamond Resorts and Silverpoint Vacations. Resorts that have all suffered numerous defeats in the Spanish courts and that have been ordered to pay money back to owners.  You can see some of these recent judgements below.

It is important to add that there are more than a thousand court judgements in Spain against RDO member timeshare resorts for illegalities in the contracts or sales processes. KwikChex, continues, in spite of this to actively suggest that RDO members are legally compliant and fail to publicise any news on these judgments nor impacts resulting from these judgements.

So should timeshare resorts that have hundreds of court cases lodged against them for having sold non-legally compliant timeshare contracts be referencing KwikChex buy with confidence trading scheme?

It seems that the relationship between Kwikchex and the RDO is in fact abusing The Scheme to benefit RDO members and breaching the permitted terms and conditions in letting resorts reference this emblem.

It may be time for Trading Standards to investigate the overall conduct of KwixChex including the use of their Buy With Confidence Scheme.
