Further to our article on Monday 16th October, in which we thank all of our contributors for their input. We are happy to publish a letter that we have received from the Chief Executive of the RDO in respect of information updates, and an article that the TCA published in 2016; which had incorrect information in it.
Off the back of this, we are more than happy to publish the part of the code of conduct of RDO direct relinquishments, specifically to those aged over 70 years that are looking to relieve themselves of their timeshare for various reasons. The RDO code was last published in 2014, and states specifically:
“In the event of the death of a joint owner, the surviving owner can surrender their timeshare if they wish and additionally, the beneficiaries of a will are not obliged to take on the timeshare if they do not wish to do so”
Therefore, this states that a timeshare will no longer need to be passed on to next of kin on death, and it no longer needs to be a burden to a surviving owner, which is reasonable. The pressure has been taken off this party after already losing a loved one, they are not then expected to find a friend to holiday with. And if desired are able to relinquish it.
Another point on their code of conduct relates to long term illness:
“If a sole owner or either of the joint owners is suffering from a long-term illness that prevents them from travelling to their resort for the foreseeable future, the timeshare interest may be surrendered.”
This is another weight off of an owners’ mind when they are already suffering from the stress of hospital visits and restricted health.
So, we can confirm it is not always the case that age is a requirement for the relinquishment of a timeshare property. Clients may be over 70, in full health, at which point they would be required to fulfil their contract with their resort.
