It has to be said, Anfi Resort remains one of Europe’s most popular timeshare resorts in Spain, however it must also be countered in that it has also committed a 10-year spree of selling unlawful timeshare contracts to current and new timeshare consumers. Illegal antics usually come back to bite a company which is the case at Anfi Resort.

The Complex have been trading since 1992 and was named as one of the world’s most luxurious timeshare resorts.  At the resort it exists, many unlawful selling practices and a disharmony of unlawful contracts.

Anfi having sold illegally thousands of timeshare contracts are the subject to many supreme court rulings for which those antics are costing the resort dearly. However, Anfi are not the only Spanish timeshare resort being hit by the legal profession, other resorts are also being subjected to many supreme court rulings again for mis-selling timeshare their contracts. Anfi is facing hundreds if not thousands of legal actions.

The emphasis on excellence and service at the resort did make the resort a cut above the rest and it can be said that Anfi is still one of Europe’s leading timeshare resorts.

The founder Billionaire Mr. Bjorn Lyng always wanted to construct a superior resort and didn’t stop until he got just that, “however, he did that with your money, not his” which was criminally gained. To that extent, Mr. Lyng powered his dream challenged with timeshare resort buildings with stone and ordered that a huge, heart-shaped island to be constructed. With the aid of imported Caribbean sand for the beaches, the resort was well presented. Today its funds are in taters and the splendid dreams of ownership are far cry from reality.

Once the first foundation blocks were laid, the battle was on to get his money back and then build more.  It’s has to be said that Anfi was Mr. Lyng’s baby. The construction of this resort boomed timeshare in Gran Canaria, this was welcomed but as stated was founded on money dishonestly obtained.

During the years of 1992 and 1999, the timeshare venders working for Anfi did pretty much as they wanted, they set up boiler rooms, invited consumers into the resort and were sold to hour after hour until many caved in and bought. The sales representatives would say anything, so long as a sale was clinched and with the support of immense network touts, and salespeople timeshares weeks were sold fast but unlawfully.

Due to the resort been constructed in Canaries Spanish law governed, however, powers that be were not prepared for the mass selling that was taking place and similarly were not prepared to deal with the many grievances from consumers that they were being mis sold by Anfi and others so, in 1998 the Spanish Law changed and  introduced a very needy legislation in the form of Law42/98 which came into effect on the 4th of January 1999.  However, the day the law was implemented, Anfi chose to ignore it and had a continuance of mis-selling the timeshare year in and year out.

It’s difficult to imagine that a man who constructed a billion-euro kingdom didn’t know exactly what was going on, or if he did he chose to ignore it. Perhaps, like many successful businessmen, he thought he could make any problem dissapear with money, as he certainly did have a huge legal team behind him., but like many, who do sell illegal products, get caught in the end.

The army of Lawyers were only concerned about one things and that was to ensure no one ever got their money back and continued to prepare illegal contracts.

Claims were ignored, delayed and appealed at every turn, so taking on Anfi became almost impossible and expensive, for that reason many consumers just gave up.

In 2015, the first case was brought against Anfi and this reached the Spanish Supreme Court in Madrid.  The Inevitable happened since it was so illegal, Anfi lost, then it lost again, again and again. To date it’s now lost many 10’s of supreme court cases. They were forced to return money to owners with damages and interest.

Timeshare consumers have always been victims and have equally been the targets of greedy Resorts but now they are finally getting their money back.

Could your Spanish timeshare contract be illegal?

If you signed a timeshare contract after January 4, 1999, there’s a very good chance it contains an illegal clause and will be annulled. In doing so, you will get your money back in full with interest, costs and damages.
