Further to our article on compensation, published here on December 8th, the TCA bring news on further compensation cases won in the Spanish courts. The three cases are all due to contracts signed in perpetuity, timeshare contracts containing floating weeks or points, or monies being paid for a timeshare contract within the cooling off period, all having been deemed unlawful in the Spanish Supreme Court.

The first case was in respect of a timeshare that was purchased at the resort of Dinastia SL in Tenerife. The contract was in breach of perpetuity, as it had a term of more than fifty years with the clients also having paid a deposit to the resort in respect of the contract during the cooling off period.  This case was heard in the courts of Arona, Tenerife where the happy ex timeshare owners were able to rid themselves of their timeshare and gain 15,950€ in compensation as well as court fees and taxes on top.

Another timeshare contract, purchased from Puerto Calma, Gran Canaria, was also deemed null and void in respect of perpetuity. The claim was heard in the courts of Las Palmas, Gran Canaria. The timeshare was purchased by a Swedish couple, whom signed the contract, which was in breach of perpetuity laws. This has left Puerto Calma with a whopping payout of 72,885€ in compensation. Furthermore, the clients will also receive court fees and accrued interests as well as becoming happy ex timeshare owners.

Last, but not least, Anfi just can’t get enough of the limelight, whether it is good or bad press, Anfi Sales SL. seem to be at the center of it all at the moment. Again, a contract signed in breach of perpetuity, was brought to trial in Las Palmas of Gran Canaria, the second in so many weeks. These Anfi clients have walked away with 9,180€ in compensation plus court fees.

These three court wins, just in the last couple of weeks, show that compensation claims are not settling down. These three timeshare owners look set to have a great Christmas with their timely wins.
