A positive step to help Resort Properties and Silverpoint victims was made recently on 1st August 2016.

The significant victory was announced in Arona Court, Tenerife, which noted two rulings which will help all future claims;

  1. The court ruled that Silverpoint was responsible for all contracts issued by Resort Properties and deems the two companies as one and the same entity.
  2. A Resort Properties contract was deemed null & void as it was for more than 50 years, as well as other irregularities with the contract.  The court used the Supreme Court rulings as precedent for this ruling. The client was awarded more than 25,000€ including maintenance fees and legal costs.

Point one has been in contention since Resort Properties announced the name change of the company to Silverpoint, as they then denied all responsibility for anything sold, or mis-sold under Resort Properties, although all staff and company structure stayed identical to that of Resort Properties.  Starting from the very top, Mark Cushway was CEO of Resort Properties and then CEO of Silverpoint.

 

 

 

When Diamond Resorts took over Sunterra, all records and members became Diamond’s property.  This is normal practice for a sale of company so the company are aware of which owner owns which week.

Resort Properties and Silverpoint were both members of the RDO and Mark Cushway was one of the directors of this organisation, yet failed to follow the codes of conduct and ethics he preached about and RDO turned a blind eye. Why would they do this?  Resort Properties / Silverpoint are main financial contributors of the RDO, it is not there to protect the consumer, it is there to protect its own members. They even state on their website, they do not investigate any complaint about any member of the RDO, you must go directly to the member concerned. What type of trade body is this?
